Pence Hails Supreme Court Decision Striking Down Trump Tariffs as Constitutional Victory
Former Vice President Mike Pence on Friday praised the U.S. Supreme Court’s 6-3 ruling that invalidated numerous tariffs imposed by the Trump administration, describing it as a major constitutional victory.
The high court determined that President Donald Trump improperly invoked an emergency statute to impose broad tariffs on U.S. trading partners, asserting such authority belongs exclusively to Congress.
In his social media post following the decision, Pence cited the case Learning Resources, Inc. v. Trump, stating: “Our Supreme Court has reaffirmed that the Constitution grants Congress — not the President — the power to tax.” He added: “American families and American businesses pay American tariffs — not foreign countries. With this decision, American families and businesses can breathe a sigh of relief.”
Pence, who has repeatedly criticized Trump’s economic policies since leaving office, previously labeled the tariff announcement a “misstep” in an interview with The Hill last April. He argued that the measures would constitute the largest peacetime tax hike in U.S. history, placing significant hardship on working families and businesses.
Pence is founder of Advancing American Freedom, a conservative advocacy group focused on limited government and free-market principles. Pence noted his organization’s amicus brief program collaborated on the legal challenge against the tariffs.
He concluded his post with: “With this historic decision, America can now return to the pursuit of Free Trade with Free Nations under the Constitution of the United States!”
Pence also shared a portion of Justice Neil Gorsuch’s concurring opinion, calling it “wisdom” and “principle.” The justice wrote that while some may find the ruling disappointing, history suggests those who are disappointed will eventually appreciate the legislative process as the bulwark of liberty.
