A majority of voters (52%) believe aides to former President Joe Biden should face criminal prosecution for allegedly using an autopen to improperly assert presidential authority, according to a Rasmussen Reports national survey. Thirty-two percent disagree, while 17% remain uncertain.

The poll also revealed that 55% of likely U.S. voters think members of Biden’s White House staff used the autopen to sign documents without his knowledge or approval, including 40% who deem it “very likely.” Conversely, 33% say such actions are unlikely, with 18% dismissing the possibility entirely, and 12% undecided.

The findings follow a report by the House Oversight Committee last week, which stated that as Biden’s physical and mental condition declined, his aides assumed presidential authority and executed executive decisions without direct approval. The committee cited instances of autopen misuse and inadequate documentation of decision-making processes.

The survey, conducted between October 28 and 30 among 1,157 U.S. likely voters via telephone and online, carries a margin of error of plus or minus 3 percentage points at a 95% confidence level. Fieldwork was managed by Pulse Opinion Research.
