The legal battle over President Donald Trump’s use of tariffs to reshape global trade and protect U.S. national security has reached the Supreme Court, where critics argue his stance defies constitutional principles. Trump escalated his criticism on Truth Social, questioning why the president is barred from imposing tariffs for national security when other nations freely impose them on the U.S.

“Other Countries can Tariff us, but we can’t Tariff them? It is their DREAM!” Trump wrote, accusing opponents of “foolishness” and claiming the tariffs have boosted America’s economic standing. He highlighted record-low inflation, a surging stock market, and plans to distribute $2,000 dividends to citizens, framing the policy as a victory for American prosperity.

The case hinges on whether the 1977 International Emergency Economic Powers Act (IEEPA) grants the president authority to levy tariffs. Lower courts have ruled against Trump’s approach but allowed the tariffs to remain while litigation proceeds. U.S. Solicitor General D. John Sauer defended the administration’s position during arguments, though the hearing revealed tensions within the court.

Justice Neil Gorsuch, a conservative justice, challenged the administration’s argument that broad presidential power in foreign policy justifies the tariffs. He warned that such reasoning could enable Congress to transfer its authority over foreign commerce and even war powers to the executive. Despite the 6-3 conservative majority on the Supreme Court, legal analysts noted Gorsuch’s skepticism as a potential hurdle for Trump’s agenda.

Treasury Secretary Scott Bessent and Commerce Secretary Howard Lutnick faced tougher scrutiny during cross-examination, signaling mixed reactions from the court. The outcome of the case could redefine presidential authority over trade policy, with Trump vowing to defend his “progressive tariff policy” as essential to America’s resurgence.
